PLEASE READ THESE PROGRAM TERMS CAREFULLY. BY PARTICIPATING IN THE PROGRAM, YOU AGREE TO BE BOUND BY THESE PROGRAM TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE PROGRAM TERMS, THEN DO NOT PARTICIPATE IN THE PROGRAM.
These Black Rock Coffee Bar Rewards Program Terms and Conditions (“Program Terms”) apply to your access to and participation in the Black Rock Coffee Bar Rewards Program (the “Program”), which is operated by Black Rock Store Operations, LLC (“Company,” “our,” “we,” or “us”). Persons under the age of 18 (“Minors”) must obtain parental or legal guardian consent prior to participation. By enrolling, you agree (or, if a Minor, your parent or guardian agrees) to these Program Terms.

PARTICIPATION IN THE PROGRAM AND DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS ARE SUBJECT TO THE MANDATORY ARBITRATION PROVISION IN SECTION 8 BELOW.
1. Overview of Program
The Program is a free-to-join customer rewards program. Members earn points (“Bolts”) through certain actions (see Section 5) which can be redeemed for Rewards (see Section 6).
2. Changes; Modifications
Company may change, modify, limit, and/or eliminate the Program and/or these Program Terms at any time in its sole discretion, including: (a) Rewards or benefits, (b) expiration of Bolts, (c) how Bolts are earned or redeemed, or (d) how Rewards are valued or redeemed. Updated terms will be posted at br.coffee/pages/rewards-terms. Continued participation confirms acceptance.
3. Eligibility
To be eligible, you must: (a) reside in the 50 U.S. states or D.C.; (b) be at least 16 years old; and (c) maintain an account at br.coffee. Limit one account per person. Program is for personal use only.
4. Joining the Program; Opt-Out
You may join by registering in-store or at br.coffee. To opt out, fill out an opt-out request or text STOP to 14805884704.
5. Earning Bolts
Members earn 2 Bolts per $1 spent on Qualifying Purchases (excluding Rewards or excluded items). Promotional offers may also grant Bolts.

7. Program Communications
Unless opted out, Company may send you marketing and promotional messages. Even if opted out, you may still receive non-marketing communications related to your account.
8. Mandatory Arbitration; No Class Actions; Governing Law
These Terms are governed by U.S. federal arbitration law and Oregon law. Disputes will be resolved through binding arbitration on an individual basis. Class actions are not permitted. See full Program Terms for details.
9. Indemnification
You agree to indemnify and hold harmless Company and its affiliates from all claims arising from your participation or violation of these Terms.
10. Disclaimers
Products and services are provided “as is” without warranties. Company disclaims implied warranties to the fullest extent permitted by law.
11. Limitation of Liability
Company’s liability is limited to the greater of $10 or the amount you paid for the products or services at issue.
12. Release
To the fullest extent allowed by law, you release Company from all claims arising from disputes with third parties.
13. Intellectual Property
All Program content, trademarks, and materials are owned by Company.
14. Miscellaneous
Company reserves the right to suspend or terminate your account for violation of these Terms. Participation is voluntary and you may withdraw anytime. You are responsible for any applicable taxes. For questions, contact us at go.momos.com/BlackRockContact.
